The General Terms and Conditions define the rules and terms that govern the use of our services and products. They specify the rights and obligations of each party, in order to guarantee a transparent and secure relationship between our company and our customers. By accessing our services, you accept these terms, designed to protect your interests and offer you an optimal experience.
COMPANY IDENTITY
Company presentation
MuralConcept is a brand of the Picturalp'design group, registered in the Annecy trade and companies register under number 884 606 781 and located at 400 route de l'aiglière ZI Fier in Argonay 74370. On its website www.muralconcept.fr, the Company, under its trade name MuralConcept, offers a product catalog specializing in wall decorations, and more specifically personalized wallpapers in the dimensions that the customer is the ordering party. The customer has all the information necessary to place his order, and benefits from support by telephone or e-mail to help him in his purchasing process. The sale between the Customer and the Company will only be completed when the customer has accepted the General Conditions, at the time of validation of his basket, before proceeding to payment.
The price of the products
The prices of the products sold through the website are indicated in euros, all taxes included, excluding shipping costs and precisely determined on the Product description pages. Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These duties and sums are not the responsibility of the Seller. They will be the responsibility of the buyer and are his responsibility (declarations, payment to the competent authorities, etc.). The Seller therefore invites the buyer to inquire about these aspects with the corresponding local authorities. The Company reserves the right to modify its prices at any time for the future. The telecommunications costs necessary for accessing the Company's websites are the responsibility of the Customer. Where applicable, also the delivery costs.
Products on the site
The products presented on the site are from the category: Wallpapers. Each Product is presented with its technical specifications and options. They are offered within the limits of available stocks, and are made to order. The colors of the photos are not contractual and may not correspond, due to the different resolutions of the screens (computer, laptop). The Company cannot therefore be held responsible for these differences attributable to the quality of the screens or the different baths of the products. These General Conditions of Sale (GCS) govern the sales of Products made through the Company's website, and are an integral part of the Contract between the Buyer and the Seller. They are fully enforceable against the Buyer who accepted them before placing an order. The Seller reserves the right to modify these terms at any time by publishing a new version on its website. The GTC applicable then are those in force on the date of payment (or the first payment in the case of multiple payments) of the order. These General Terms and Conditions of Sale can be viewed on the Company's website at the following address: www.muralconcept.fr. The Company also ensures that their acceptance is clear and unconditional by setting up a checkbox and a validation click. The Customer declares that they have read all of these General Terms and Conditions of Sale, and where applicable the Special Terms and Conditions of Sale related to a product and accept them without restriction or reservation. The Customer acknowledges that they have received the necessary advice and information to ensure that the offer is suitable for their needs. The Customer declares that they are able to legally contract under French law or validly represent the natural or legal person for whom they are committing. Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.
ORDER AND CONCLUSION OF THE SALES CONTRACT
Order
In accordance with the provisions of Article 1127-1 of the Civil Code, the Customer must follow a series of steps to conclude the contract electronically in order to be able to place his order: Creation of a customer account Information on the essential characteristics of the Product; Choice of the Product and its options (size, color) Indication of the Customer's contact details (identification, email, address, etc.) Acceptance of these General Terms and Conditions of Sale Verification of the elements of the order and correction of errors. Before proceeding with his confirmation, the Buyer has the possibility to check the details of his order, its price, the delivery time and to correct any errors, or cancel his order. Validation of the order will result in the formation of this contract. Then, followed by instructions for payment, payment of the products, then choice of the delivery method for the order. The Customer will receive confirmation by email of the payment of the order, as well as an acknowledgment of receipt of the order confirming it. The order date is the order validation date, this may take several days depending on the payment method used. The language for concluding the contract is French. The terms of the offer and the general conditions of sale are sent by email to the buyer when ordering and archived on the Seller's website. Where applicable, the professional and commercial rules to which the author of the offer intends to submit are available at the bottom of the page and are available on the Seller's website at the following address www.muralconcept.fr. The archiving of communications, the order, the order details, as well as invoices is carried out on a reliable and durable medium in order to constitute a faithful and durable copy in accordance with the provisions of Article 1360 of the Civil Code. This information may be produced as proof of the contract. For delivered products, delivery will be made to the address indicated by the Customer. For the purpose of proper execution of the order, the Customer undertakes to provide his/her true identification details. The Seller reserves the right to refuse the order, for example for any abnormal request, made in bad faith or for any legitimate reason. In the event of unavailability of an ordered Product, you will be informed by e-mail. For any questions relating to the tracking of an order, you can contact us by e-mail (contact@muralconcept.fr) or by telephone, from Monday to Thursday, from 9:30 a.m. to 5:30 p.m. and Friday from 9:30 a.m. to 12 p.m.
Cancellation of order
In the event of cancellation of an order by the customer: compensation equal to or greater than 50% will be retained by the Company. It may reach 100% of the price if the products have been specially manufactured for the customer: wallpaper to your measurements. In the event of cancellation with partial reimbursement, the reimbursement period will not exceed thirty days from the date of acceptance of the cancellation by the Company.

Payment
The price is payable upon ordering. Following the order date, a request to debit the bank account will be sent within three (3) days to the buyer's bank. The order will be considered final after approval by the payment center. Online payments will be made through the secure system, so that the information transmitted remains encrypted and no third party can read it during transfer over the network. It is the buyer's responsibility to save and print their payment slip if they wish to keep the details of the banking transaction relating to the transaction. At the buyer's request, they will be sent a paper invoice showing the VAT.

Via your PAYPAL account, by choosing payment via PayPal, You will be automatically directed to your PayPal account. In the case of payment by check, the order will only be validated upon receipt of the check on the back of which the Customer will have taken care to indicate the number of the corresponding order. VAT in the European Union and outside the European Union
European Union VAT
In each country belonging to the European Union, there are turnover thresholds that must not be exceeded for invoicing to a particular Customer. Up to the turnover threshold of the European Union country, the VAT that applies is that of France. Above the turnover threshold of the European Union country, the VAT that applies is that of the country receiving the goods.
VAT outside the European Union
Whether it is an invoice to a private customer or a professional customer, you are exempt from VAT. We inform you that all payment particularities will be studied on a case-by-case basis and according to current legislation, also with regard to delivery costs. Deliveries outside the European Union must be requested first via the contact page.

DATA PROTECTION AND INTELLECTUAL PROPERTY
Protection of personal data
MuralConcept, as Data Controller, undertakes to comply with the provisions of Law No. 78-17 of 6 January 1978, as amended, relating to information technology, files and freedoms with regard to the automated processing of personal data carried out, as well as Regulation (EU) No. 2016/679 of 27 April 2016, as of its application on 25 May 2018. When you place your order, the personal data collected will be subject to computer processing. You are invited to refer to our Privacy Policy section of the Website to obtain all the information relating to this point.
Intellectual property
All elements of the Website are and remain the intellectual and exclusive property of MuralConcept. No one is authorized to reproduce, exploit, distribute, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or audio. Produced under Warner Bros license (Harry Potter, looney...) No. 583004. Resale authorization on behalf of Adawall. Techniques such as "framing" or "in-line linking" are strictly prohibited.
DELIVERY
Delivery methods and costs
Delivery rates are visible when updating the product basket. The corresponding delivery time is indicated for delivery in Metropolitan France on the product sheet as well as in the basket. We send our packages, depending on the location, with the following carriers: Colissimo, Chronopost, DPD or DHL.
Delivery times
MuralConcept is committed to shipping orders as quickly as possible. The average delivery time is between 10 and 15 working days from the date of validation of the order. Delivery times may sometimes exceed the average time by a few days in the event of events beyond our control such as bad weather, a carrier error or a temporary overload of our production workshops. Indeed, the majority of the products offered are made to measure and require manufacturing and preparation time. During commercial operations such as sales, our production workshops may encounter difficulties in processing all orders within the allotted time. This period will never exceed more than 30 days.
RETURN AND COMPLAINT

Return and refund of ordered products
All products supplied benefit from the legal guarantee provided for by article 1641 and following of the Civil Code. In the event of non-conformity of the product, it may be returned to us for an exchange or refund. All claims for lack of conformity, requests for exchange or refund must be made within fourteen days after the date of delivery, by notifying it by e-mail to contact@muralconcept.fr and by returning the product by post to the following address:

Any product accepted for return but damaged upon arrival at MuralConcept will not be eligible for a refund. If its condition makes it unfit for sale, you will be informed as quickly as possible.

Claim
It is your responsibility to check the conformity of the goods before installation, whether it is carried out by a professional or not. A wallpaper defect noted after installation cannot be the subject of any claim. Under no circumstances can the installation costs incurred by a professional or a service provider be claimed. Any claim based on the non-conformity of the products delivered or on an apparent defect must be sent within fourteen days from the date of receipt of the goods, to contact@muralconcept. After installation, the products will be considered accepted and recognized as compliant.

If you notice a defective product, it is essential to send us a photo of the box and the product by email to contact@muralconcept.fr.
Any claim must be made before the product is installed. We remind you that installing the product implies acceptance as is. Checking your wallpaper is necessary before installation to avoid any pitfalls and judge the product as is. We will not be able to respond favorably to a claim that concerns wallpaper handled by a third party. Installed wallpaper is subject to modifications during installation.
Transport damage
MuralConcept advises you to check your package at the time of delivery. The Customer or his representative must check the goods in the presence of the duly authorized carrier. In the event of damage(s) due to transport, the Customer, as recipient, must expressly notify the reservations to be made within the time limits to the carrier, and send a copy to MuralConcept, failing which MuralConcept reserves the right to refuse the return, refund or replacement of the products.

Product preservation
MuralConcept will not be required to keep for the customer products paid for but for which a delivery address has not been given or is incorrect. In this case, after a period of 3 months, the products will be put back on sale and the price retained by MuralConcept. If the delivery could not be made for reasons of accessibility or absence of person to receive the products, the Company cannot be held responsible. Products returned to MuralConcept due to delivery error or absence of the recipient will be sent again at the exclusive expense of the Customer, and according to its written terms.
Before placing your order, we invite you to make all necessary arrangements (choice of model, size, appearance, colours, purchase of sample), in order to ensure that the wallpaper received will correspond to your expectations.
PRODUCT AND RESPONSIBILITIES
Limitation of Liability
MuralConcept's liability is strictly limited to the value of the goods recognized as non-compliant, defective or defective, without compensation of any nature whatsoever and for any reason whatsoever.
Disclaimer
MuralConcept declines all responsibility for the misuse or improper use of the products that the customer has ordered. The Company is in no way responsible for the consequences resulting from: the storage of products in abnormal conditions or conditions incompatible with their nature, their transformation, failure to comply with installation instructions, abnormal wear resulting from poor maintenance, or imperfect installation, deterioration of products due to water infiltration, shocks or inappropriate uses, temperatures or humidity levels.
Bonds
MuralConcept has an obligation of result for all stages of order taking as well as for all stages subsequent to the conclusion of the contract. Thus, the Company undertakes to describe with the greatest accuracy the Products sold on the Website. On the other hand, the Company cannot be held liable in the event that the non-performance of its obligations is attributable either to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure as defined by French case law. Similarly, the Company cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a service interruption, an external intrusion or the presence of computer viruses. The Company remains the owner of the products delivered until their full payment by the Customer. The risks related to transport will be borne by the customer from the departure of the products. In cases of force majeure, transport strikes, road blockages, natural disasters or inability to travel, the company will not be held responsible for poor delivery times or non-delivery.
